Justice Department Inspector General Michael Horowitz issued a report on Thursday confirming that the FBI had deployed over two dozen confidential human sources among the protesters at the Capitol on January 6, 2021.
The 79-page report rigorously evaluated the FBI’s management of confidential human sources and intelligence collection efforts leading to the Capitol incursion.
On January 6, there were (26) confidential human sources “actively present on the ground.” Notably, (4) of these sources “entered the Capitol itself,” while an additional (13) accessed the “restricted area surrounding the building.”
“According to the report, none of the FBI’s Confidential Human Sources (CHSs) were authorized to enter the Capitol or any restricted areas, nor did the FBI ever direct them to engage in illegal activities or encourage others to do so on January 6.”
The Office of Inspector General confirmed that a significant number of these 26 CHSs supplied crucial information about the January 6 Electoral Certification before the event, and several CHSs effectively communicated details about the riot as it unfolded.
The OIG has uncovered records indicating that a confidential human source who entered the Capitol received reimbursement for travel expenses incurred during the incursion and for attending President Joe Biden’s inauguration on January 20, 2021.
George Washington University law professor Jonathan Turley firmly stated that the IG’s report raises significant questions rather than providing clarity. He emphasized that it confirms that confidential sources did enter the Capitol and restricted areas.
The question is whether the presence of these sources was disclosed to the defense in the prosecutions. He noted, “The Inspector General suggests these sources were not involved in the core criminal conduct that day.
If this were revealed, defense counsel would not accept the government’s explanation.” Turley expects House committees will have more questions about the role of these FBI sources on January 6.
In January 2022, GOP Sen. Ted Cruz of Texas questioned then-FBI Assistant Executive Director Jill Sanborn during a Senate Judiciary Committee hearing about how many confidential human sources the FBI had on the ground during the Capitol incursion.
“How many FBI agents or confidential informants actively participated in the events of Jan. 6?” “Sir, I’m sure you can appreciate that I can’t go into the specifics of sources and methods,” Sanborn answered.
Cruz asked.“Did any FBI agents or confidential informants actively participate in the events of Jan. 6? Yes or no.” Sir, I can’t answer that,” replied Sanborn.
“Did any FBI agents or confidential informants commit crimes of violence on Jan. 6?” Cruz then queried. Sanborn would not say.
The senator continued, “Did any FBI agents or FBI informants actively encourage and incite crimes of violence on Jan. 6?” Sir, I can’t answer that,” Sanborn said.
Cruz closed his line of questioning, saying, “Ms. Sanborn, a lot of Americans are concerned that the federal government deliberately encouraged illegal and violent conduct on Jan. 6.”
