Why the First Amendment Is in Danger Like Never Before “Free Speech Was Given to Us by Jesus”

After Donald Trump’s re-election, free speech advocates anticipate his return to the Oval Office. During his campaign, he pledged to protect free speech, especially when some argue that the First Amendment is outdated and needs to be redefined.

The people who don’t like free speech are the left Democrats. They only want to hear from people who have the same views as they do, and everything else that they don’t want to hear they claim is not true or is labeled as hate speech. When you take away free speech, your freedom is taken away.

“Trump has pledged to prioritize free speech as a key component of his platform, emphasizing the need to stop the censorship of information. To address this issue, a recent editorial in the Wall Street Journal suggested implementing an executive order requiring federal employees to report any actions encouraging private companies to infringe upon individuals’ First Amendment rights to the Office of Management and Budget (OMB).” The OMB would then publish these reports online.

Some suggest reevaluating the traditional interpretation of free speech rights, often considered unlimited under the First Amendment to the U.S. Constitution. In 2017, Timothy Wu, a professor at Columbia Law School, stated that the right to free speech is “entering a new period of political irrelevance.”

A year later, he expanded on this idea during a forum at the Aspen Institute, asking whether “the First Amendment to the United States Constitution has become obsolete.”

Since then, certain U.S. political figures, such as former Secretary of State John Kerry, have raised concerns about how freedom of speech in the era of social media facilitates the spread of false information. “If people rely on only one source, and that source is biased or has an agenda, it can spread disinformation,” Democrat Kerry emphasized. “Our First Amendment is a significant barrier to simply eliminating that information.”

George Washington University Law Professor Jonathan Turley warns that we are in a dangerous anti-free speech period due to an unprecedented alliance among the government, media, academia, and corporations. He believes this fosters a generation fearful of free speech, as they’ve been taught that it is harmful and that they don’t need to hear opposing viewpoints. Turley argues that convincing a free people to relinquish their freedom is challenging. They have to be afraid or angry, and that’s what we’re seeing,” Turley said.

New York University Law School Professor Kenji Yoshino believes a new landscape exists in the United States today.”Anyone with a social media account can be a publisher of their speech. And that’s a wonderful thing from the perspective of expression. But we also need a different model that says the only threat to speech or the primary threat is not necessarily government,” Yoshino said.

Yoshino argues that the American commitment to free speech needs updating due to significant changes in the political and cultural landscape since the First Amendment was established. In the past, people primarily expressed their views at school board and city council meetings or through letters to newspapers, which often censored or rejected their submissions.

With smartphones, almost everyone can express their views on platforms like Facebook, Instagram, and X, giving many previously marginalized individuals a voice. However, this also includes the spread of false information and hate speech. While the First Amendment protects such speech, it presents significant challenges. As Dr. Keith Whittington from Yale Law School notes, “Sometimes that means you’re going to protect some Nazis or Klan members.”

Some legal scholars and politicians support creating oversight boards to monitor social media speech, but Whittington finds this problematic. He warns that empowering officials to decide which speech to protect or suppress could harm democracy and societal progress.

Turley believes Americans must understand this right was granted to humanity by the Creator, not the government. “The government is responsible for safeguarding this right, and each generation must actively defend it.”We have to have a type of awakening. You know, we have to remind ourselves of why this right is indispensable… Because if free speech was given to us by God, if it is part of being human if it’s in our DNA, then you can never really kill it without killing us.”
