Nearly 40,000 Chinese nationals are included in the over 1.4 million noncitizens who face deportation orders but are not currently in detention by Immigration and Customs Enforcement (ICE). This highlights a significant gap in the enforcement of immigration policies.
As of November 24, 2024, 1,445,549 foreign nationals were on ICE’s non-detained docket with final orders of removal. This docket includes noncitizens in removal proceedings who are not in ICE custody.
Over 7 million people are on that docket, including those incarcerated by federal, state, or local law enforcement but not by ICE. Those in ICE custody are on the detained docket.
The countries with the most nationals on the list are Mexico (252,044), Guatemala (253,413), Honduras (261,651), and El Salvador (203,822). Other notable countries include China (37,908), Haiti (32,363), Iran (2,618), Pakistan (776), Uzbekistan (975), and Venezuela (22,749).
China is seen as a geopolitical rival of the U.S., raising concerns among Republicans about espionage and cyberattacks by the Chinese Communist Party. Recently, the Justice Department reported that a Chinese illegal immigrant shipped weapons to North Korea from California.
Lawmakers have requested a breakdown of the nationalities of illegal immigrants and the reasons complicating their deportation. The number of illegal immigrants on the non-detained docket increased from 3.7 million in the fiscal year 2021 to over 7 million in the fiscal year 2023.
Some individuals on non-detained dockets are recent arrivals, while others have been in the U.S. for decades. ICE explained that it cannot provide specific reasons for not deporting those with final orders of removal, but factors include ongoing appeals, other forms of deportation protection, and participation in Alternatives to Detention programs.
“Noncitizens can seek relief from removal through asylum, withholding of removal, or protection under the Convention Against Torture. If granted such relief, ICE cannot proceed with removal. About 55% of final orders are executable, but this can change as case circumstances evolve.”
Several countries are refusing to accept their nationals’ return flights. Fifteen countries are labeled as “uncooperative”: Bhutan, Burma, Cuba, the Democratic Republic of the Congo, Eritrea, Ethiopia, Hong Kong, India, Iran, Laos, Pakistan, the People’s Republic of China, Russia, Somalia, and Venezuela.
Eleven countries are at risk of non-compliance: Bosnia and Herzegovina, Burkina Faso, Cambodia, Gabon, Gambia, Iraq, Jamaica, Nicaragua, South Sudan, St. Lucia, and Vietnam. “These alarming statistics should serve as a wake-up call for policymakers.”
Congress must fully support the incoming Trump administration in reversing damage to our immigration system while enforcing laws and securing borders. The administration faces significant challenges in implementing a mass deportation operation in January. The border czar prioritizes public safety but has stated that no undocumented immigrant will be exempt from deportation.
